Court Denies the Defendant’s Motion For Summary Judgment in Slip and Fall on Ice Action
Judge Peter Lynch denied the Defendant’s motion for summary judgment in a slip and fall action that occurred on December 30, 2018 at a Colonie diner parking lot. Our client and fiance were walking across the diner’s parking lot when she suddenly slipped on ice suffering a significant injury to her cervical spine, which required a fusion surgery. The court found that the defendant had imputed notice of the dangerous condition based on a lack of any reasonable inspection of the parking lot on the morning of the accident. The court noted that the defendant’s own records established that the ice had for a sufficient period of time to treat it.
